Three of TVXQ's members in Korea are still in a dispute with their company, while in Japan, they have once again proven that they are Asia's best.

Oricon Chart news reported on the 23rd that TVXQ's "BEST SELECTION 2010" has sold 413,000 copies, and that it took the top spot in the March Oricon Monthly Chart; this is the highest record for a foreign group. The record was previously set by Bon Jovi's "These Days" which was released in June 1995 with 379,000 copies sold. From the 17th of February, the local sales of "BEST SELECTION 2010" came to a total of more than 200,000. From this, we can see how they took first place consecutively for days, and after a week created the record of selling more than 400,000 copies. After their debut in Japan last April 2005, this is the first time they claimed the top spot through an album, and not a single; of course, they were also the first Korean boy band to do so. Up until now, the best album chart ranking was their 4th Japanese album "The Secret Code" last March.

Oricon stated that, "Just like last year's total album sales got the good result of 'BEST 3' in the charts, the TVXQ who soared high in 2009 were chosen to be models for the cover page of women's magazine 'JJ.' Their popularity cannot be stopped," and more comments like these.

This album is a collection of the members' chosen songs; the CD+DVD version includes 11 songs' PVs. The 2CD+DVD version is a compilation if the members' handpicked songs, new song "Tokiwo Tomete," public download limited song "Endlessly Sweet," and the theme song of this year's movie to be released in September, "With All My Heart." "Endlessly Sweet" and a mix of currently hot song "TVXQ NONSTOP-MIX VOL. 2" will be meeting everyone shortly.

On the other hand, this time's "BEST SELECTION 2010" will be released in Korea on the 5th of March; album stakeholders are concerned about the result because it's difficult nowadays to sell CDs in Korea. In 2008, the official 4th Korean album "MIROTIC" exceeded 500,000 copies in Korea, being hailed as the top-selling album for that year.

A founder of the SM entertainment resigned from SM.

SM entertainment spokesman explained that,
“from now on Lee Soo Man will focus only for future foreign production activities.”

Lee Soo Man will withdraw from his duties at SM (Korea) which he founded in 1995.
He will formally resign from a public management director’s position on the 25th,
and stay only as a main shareholder of the SM entertainment in Korea.

However, it is expected that no particular change will be made at SM after his resignation
from the director’s position since SM (in Korea) has been administered by the representative Kim Myongmin.

However it could bring the case that the SM artist’s situation/내실
could be strengthened/improved/강화될 due to this change at SM entertainment (Korea).

Recently Avex sold their stock to Lee Soo Man and Neowizbugs.

We are so close, so I watched DVD with her, and without knowing how and when it happened, I became fan of TVXQ too! ^^ They sing and dance so well and all five of them look great! I love the fact that they are such a good friends with each other. That’s how we guy friends should be! I purely love all members of TVXQ!

21 years old, student: I am Xiah fan. I am a guy who likes women. But, TVXQ is the guys who look super cool in my eyes. I love “purple line” and I often imitate TVXQ fashion. I would love to find more male fans of TVXQ to be my friend.

Dong Bang Shin Ki court mediation failed, court decision to be revealed soon 15 Oct 2009 7:49 PM (15 years ago)

The three members of group Dong Bang Shin Ki who have unfair contract dispute with their agency SM Entertainment presented at the court secretly on last October 13th, however had failed to reach agreement with SM.

Previously on October 12th, the two side had submitted a final official stand documents that have been required since early this month for review to make final decision.
At the end of July this year, 3 Dong Bang Shin Ki members (Jaejoong, Yoochun, and Junsu) filed their disposition application to Seoul Central District Court to terminate the exclusive contract effect against SM Entertainment.

Reportedly on July 30th at 4 pm, wearing sunglasses, the members entered hurriedly to the side entrance of the court building. They secretly received report about the trial request date and other information regarding the case was not disclosed. There was no appearance of the fans, and even most of court staffs couldn’t recognize the three members who disguised themselves just like ordinary civilians and they could move without any fuss.

On August 22nd the legal representative of the 3 members forwarded members’ thought to the court, “We found it very difficult to improve and reach our goals in this industry if we live under SM’s management with all its terms and conditions.”

It’s also reported that, “The arguments happened with SM Lee Soo Man regarding this dispute already reached our highest limit of emotion.” Meanwhile the other two members who don’t participate in the legal case and still have listed activities with SM said, “It’s not possible to breakdown a group of 5 people who actually still want to work together.” showing their intention to keep shinning together as a group.

After the failure of yesterday’s mediation between two sides, court won’t summon the 3 members any further and will make its final decision soon.

Idol group Dong Bang Shin Ki’s 800K strong fanclub Cassiopeia has planned to show their support for their idols through their united act.

A fanpage ‘DongNaeBangNae’ recently put up a notice to call out to fans to boycott SM Entertainment by not buying products from SM Entertainment on 12th August.

Recently, with the lawsuit between SM Ent and Dong Bang Shin Ki member Xiah JunSu, Micky YooChun and Hero JaeJoong over contract problems, SMTown Live 09 concert to take place on 16th August was postponed indefinitely.

SM Entertainment revealed recently, “We split profits with group Dong Bang Shin Ki at the ratio of 4:6.”

Revealed on MC programme “Current Affairs Magazine 2580′ aired on 9th August, Dong Bang Shin Ki has brought in a recorded 49.8 billion KRW. Of these, SM has invested 22.4 KRW. And the rest was split between the group and SM at 4:6.”

SM said, “Of the benefits, Dong Bang Shin Ki gets 4 proportions and SM gets 6 proportions. Of the 27.4 KRW, Dong Bang Shin Ki gets 11.0 KRW and SM gets 16.4KRW.”

It was also revealed that for overseas promotions, Dong Bang Shin Ki gets 7 and SM gets 3 proportions.Also for overseas event, CF revenues, they are split at 7:3.

But according to the 3 members of Dong Bang Shin Ki, “The splitting of profits is not transparent. We cannot trust them.”

And also about their 13-year contract, SM said, “We also secured the time when the group went overseas to promote. In Korea 3~4 years, in Japan 3~4 year, in China, it was 3~4 years.”

Phone interview with the Dong Bang Shin Ki Xiah, Micky and Hero’s legal representative, Im Sang Hyeok from SeJong on their lawsuit against SM.

New news update from the Japanese company:

“Looking at Dong Bang Shin Ki’s situation now, we see that there will be no change to their Japanese activities”

Dong Bang Shin Ki’s Japanese company AVEX Entertainment talked about their stand after news of the group’s 3 member went to apply for retractile fo their exclusive rights effects from their contract with SM.

They posted an official statement on their official website on 1st August, saying “We are confirming the details of the Dong Bang Shin Ki’s problems with SM which arose yesterday. But we have not grasped fully the situation.”

“We apologise to fans for all the confusion and worry. Even though we are sorry to everyone, we hope you would understand.”

Dong Bang Shin Ki participated in the summer song festival with AVEX singers on 1st August. There are also plans for them to perform on ‘A-Nation’ concert this month.

-The core of the disagreement.
Unreasonable contract. In the Fair Trade Commission, the contract period should not be longer than 7 years. Of course, during the trainee period there are occassion that the singers choose to develop their contract but some of the terms given to Dong Bang Shin Ki, FTC have find it unfair in many ways.

- Also the cosmetics enterprise which three member and their parents running became known as one axis of the conflict.
“The cosmetics company could be one of the reasons for the discord but not what ultimately convinced the three members to go to court. We have examined the official statement from SM this morning and noticed that SM had painted the cosmetics company as the cause in a negative light on the surface of their statement. If they think that the additional business of the members is the legal case, then it’s a mistake.”

- There’s a conclusion appearing about the crisis that the activities of 3 members who file the lawsuit will be stopped?
(I cant understand this one in details, but basically he said that the members would continue if their disposition is approved, and he hoped it would be soon. The court’s desicion is now in the middle of the most important and difficult variables and he had goal to finish the case within 6 months.)

- The possibility of winning?
“To see it on the bright side… SM Entertainment has in the past been ordered by the Korea FTC several times to reform contracts for violating the standard contract limits. TVXQ are now appealing for the parts that are different from the FTC terms.

- Before taking the legal action, it’s said that the members did not try to make consultation with the agency before.
“We have tried to solve the problem through dialogue. Members had even met directly with the agency. While I was also trying to resolve the problem through multiple channels. However, the agency ignored members opinions, therefore a legal appeal finally made. The members are very sorry to the fans as well.

- What is the conflict regarding to cosmetic issue?
“Should an agency has a fight with artists who are having family’s personal investment? Other celebrities are common to have additional business. Moreover, the three members had already made consultation process with agency representative, Kim Young-Min before they started the cosmetic business, but we feel betrayed then as the company told another story later on.

- TVXQ has already taken the step, but eventually dismantled
“We have already tried many ways, but all the efforts finally bring us here. We’re not too hasty to be in this position. We create legal procedure first before we present every single new plan. The 5 people based their activities together in SM Entertainment, therefore it will not be easy to be in our situation now. “

- Is there a plan for press conference?
It’s necessary but as for now, we don’t have any plan yet. The members are really sorry now to the fans. Actually we want to proceed this case undisturbed.
In addition, according to him as well, from Star News that the members have never been informed with the accurate details of their income from the agency. Therefore in general, the members asked a claim to clean up the damage regarding this matter. As for now, the law firm can not confirm clearly the details of income submitted in the same application.

Everyone else is becoming more frantic. These words have become like a needle in a haystack of rumors now. Even though this statement has been made people are saying it will be hard for the boys to remain as a group now. Even though that is just a rumor we are still unsure as to what will happen with the boys now. I'm so worried I don't know what to do. I wish they would make a statement to assure us they will not disband.

But nevertheless, we want to assure the boys we are always on their side so please sign this petition made by Jenny25 at soompi. It will be sent to the boys in a few days so hopefully it will encourage them to continue on.

Dong Bang Shin Ki Xiah, Micky and Hero for a lawsuit against SM? 31 Jul 2009 5:53 AM (15 years ago)

One of Asia’s biggest group Dong Bang Shin Ki, has 3 of its members in a possible lawsuit against their own company SM Entertainment.

Dong Bang Shin Ki members Xiah JunSu, Micky YooChun and Hero JaeJoong had gone to Seoul Central District Court to hand in an application for provisional disposition to terminate all effects of their exclusive belonging rights contract with SM on 31st July.

It has been known that their reasons for doing so is that the contract with SM Entertainment has many irrelevant conditions attached. It is also known that the content to the contract the 3 members cannot agree to includes having them belonging exclusively to SM Entertainment for 13 years and also unhappiness over profit allocation.

The lawyer responsible for this case said, “We are currently preparing for a lawsuit against SM for this contract. (About the reasons to why) We cannot reveal the details now.”
There has also been saying that the 3 members have differing views to SM on their upcoming ‘Dong Bang Shin Ki cosmetic enterprise expansion’.

Currently out of the 3 members, JunSu is already doing a cosmetic business with his parents. It is said that there were plans for the company to operate a cosmetic business, with sheep placenta as the main ingredient, using the group’s name as the brand name in Seoul GangNam and GyeongGiDo IlSan. It is said that there were also plans for the business to be launched in China bringing in hundreds millions KRW in profit.

But it has been said that the 2 sides are having some differing views and also complications arose through their discussion on how the product and brand will go.

More DBSK Dramas: Changmin to Make Acting Debut 28 Jul 2009 7:00 AM (15 years ago)

First, it was Jaejoong. Then, it was Yunho. Now, DBSK's maknae Max Changmin has joined the group's ever-growing acting club, as he is set to star in an upcoming drama titled "Paradise Meadow".

Besides Changmin's casting, few details have been released so far about this Samhwa Networks-SM Entertainment romantic melodrama. First Shop of Coffee Prince's Jang Hyun Joo and Into the Sun's Suh Hee Jung co-wrote the script, and shooting starts at the end of August in Jeju Island, but as of now, there are no news of any rumored or confirmed co-stars.

Changmin's entrance into the acting world means that the only non-acting DBSK members are Yoochun and Junsu.
